Habeas corpus ad subjiciendum

Known as the "Great Writ", the writ of habeas corpus ad subjiciendum is a legal proceeding in which an individual held in custody can challenge the propriety of that custody under the law. The prisoner, or some other person on his behalf (for example, where the prisoner is being held incommunicado), may petition the court or an individual judge for a writ of habeas corpus.

Although the form of the writ of habeas corpus implies that the prisoner is brought to the court in order for the legality of the imprisonment to be examined, modern practice is to have a hearing with both parties present on whether the writ should issue, rather than issuing the writ immediately and waiting for the return of the writ by the addressee before the legality of the detention is examined. The prisoner can then be released or *bailed* by order of the court without having to be produced before it.

The right of habeas corpus—or rather, the right to petition for the writ—has long been celebrated as the most efficient safeguard of the liberty of the subject. Dicey wrote that the Habeas Corpus Acts "declare no principle and define no rights, but they are for practical purposes worth a hundred constitutional articles guaranteeing individual liberty". In most countries, however, the procedure of habeas corpus can be suspended in time of national emergency. In most civil law jurisdictions, comparable provisions exist, but they are generally not called "habeas corpus"

Also, here's an interesting story I stumbled upon that has all the makings of a lovely bipartisan battle. However, what I found interesting was laying aside any partisan politics and merely reading the story while pondering the question, "How shall we - by law - definine 'Political'?"

Tonight I'll be performing my play Five Bells for 9/11 (GCBC.org).

Each time I prepare to perform this piece I go into mourning. This year I saw it coming, so I had a number of people praying for me. God answered those prayers by giving me insight: This whole play was written to give people new memories, but as humans the things we remember most are those that are most emotional. So I learned to use the play for what it's designed for! When I think about all those that died I think about the more than 70,000 that were spared. When I get lost in thought about the immensity of the disaster I dwell on the way God gently helped one of the characters find the way home (there's a chance she'll be there tonight). When I feel myself dwelling on the images of distruction, I remember the cross in the rubble. The Word of God said it long ago: Philippians 4:8 (NIV) Finally, brothers, whatever is true, whatever is noble, whatever is right, whatever is pure, whatever is lovely, whatever is admirable--if anything is excellent or praiseworthy--think about such things.
